Our approach
When a government body, court, or law-enforcement agency requests user data or content removal, we require valid legal process and disclose only what we are lawfully required to — and only after careful review. This page explains how we handle those requests.
What we require
- A request must come through an official channel and be properly authenticated.
- It must cite valid legal authority that actually reaches Apperah and the data sought (e.g., a court order or warrant appropriate to the jurisdiction).
- We do not hand over user data in response to informal requests.
- We read requests narrowly and challenge those that are overbroad, vague, or improper.
Cross-border requests
Apperah is established in the EEA. A request from a foreign authority generally must come through a recognised legal channel — a Mutual Legal Assistance Treaty (MLAT), the EU e-Evidence framework, or an equivalent — before we can lawfully produce data. A foreign order, on its own, is not enough.
Emergencies
Where there is a genuine, imminent risk to someone’s life or safety, we may disclose limited data on an emergency basis, with senior and legal sign-off, and we document the decision.
Telling you about a request
We aim to notify you if your data is requested, so you have a chance to respond — unless we are legally prohibited (for example, by a non-disclosure/gag order) or notice would endanger someone or prejudice an investigation. Where we are prevented from notifying you immediately, we do so once the prohibition lapses.
Preservation
We may preserve specific data when a competent authority validly asks us to, pending a formal request.
Transparency
We count every request and publish aggregate numbers (how many requests, from which kinds of authority, and how we responded) in our periodic transparency reporting — see Security Incidents & Transparency. This reflects Digital Services Act Article 15.
