How to report copyright or trademark infringement, and our takedown process.

Our approach

Apperah respects intellectual-property rights and expects everyone using Apperah to do the same. If you believe content on Apperah infringes your copyright, you can ask us to remove it, and we act on valid notices. This policy describes the process under the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you’re in the EU/EEA, you can also use the notice route in our Acceptable Use Policy (which reflects the EU Digital Services Act).

Send a written notice to our Designated Agent (below) that includes the elements required by § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or someone authorised to act for them.
  2. Identification of the copyrighted work you say has been infringed.
  3. Identification of the infringing material and enough information for us to locate it (e.g., a link or the place/post in question).
  4. Your contact details (name, address, phone, email).
  5. A statement that you have a good-faith belief the use is not authorised by the owner, its agent, or the law.
  6. A statement that the information is accurate, and — under penalty of perjury — that you are authorised to act for the owner.

Submitting a notice that misrepresents that material is infringing can make you liable for damages under § 512(f). If you’re not sure whether something infringes, seek legal advice first.

Our Designated Agent will be registered with the US Copyright Office (DMCA Designated Agent Directory) before launch; § 512 safe-harbour applies once that registration is in place.

What happens after a valid notice

  • We remove or disable access to the material expeditiously.
  • We notify the person who posted it and give them a copy of the notice.
  • We keep a record for our transparency reporting.

Counter-notification (§ 512(g))

If your content was removed and you believe that was a mistake or misidentification, you can send a counter-notice to contact@apperah.com including: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake; your contact details; and your consent to the jurisdiction of the appropriate court. If the original complainant does not file a court action within 10–14 business days, we may restore the material.

Repeat infringers (§ 512(i))

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

Reporting alleged trademark infringement

Trademark claims follow a separate route from copyright claims. If you own a trademark and believe a name, logo, or other content on Apperah infringes your mark or is likely to cause confusion as to source or affiliation, send a notice to trademark@apperah.com that includes:

  1. Your trademark, and the registration details (or the basis for your rights) and the country/countries where you hold it.
  2. The goods or services your mark covers.
  3. Where the alleged infringement appears on Apperah — a link or enough detail for us to find it.
  4. Why you believe the use infringes or is likely to confuse.
  5. Your contact details, and a statement that the information is accurate and your report is made in good faith.

We review trademark reports and may remove content, require a change, or take other appropriate action. Fair, descriptive, and nominative references — and other lawful uses — are allowed. If you want to use the Apperah name or logo, see our Brand Usage Guidelines.
